TERMS & CONDITION
All transactions are governed under the laws of the State of Texas which apply to and interpret your and Pioneerpowersports.com rights, duties, and obligations arising from these transactions, as supplemented or modified by this Agreement, without regard to conflict of law principles. We have the right to refuse service. Pioneer Powersports Store will only accept your order only if you accept the terms of this Pioneer Powersports Acquisition Agreement (“Terms & Conditions Agreementâ€), (2) you provide valid shipping to address within the United States, and (3) The Product or Service is available.
You accept the terms of this Agreement by clicking to accept these terms and completing your transaction when ordering online or, when ordering by any other means or, by opening the package containing the Product.
SHIPPING POLICY
YOUR ORDER PROCESSING
Our standard procedure will process your order within 48 hours after your payment and confirmation is received. Once payment has been collected, it will take about 24-72 hours to process and ship your order depending on the order volume at the time.
The fully Assembled Package will take longer due to assembly, testing, and dispatching.
All orders received on weekends and holidays will be processed on the next business day.
During the holiday season and busy season, due to extremely high volume, it may take longer to process orders. To process your order smoothly, clear information such as phone number, address, and instructions are essential.
SHIPPING INFORMATION VERIFICATION
For placing an order by credit card or debit card, your shipping address must be verified if it is different from your billing address. We will ask you to fill out an authorization form and sign it. Your order may be delayed shipping until we receive and review your signed authorization form.

SHIPPING CARRIER
Merchandise Under 120 Lbs./box:
These packages will be shipped by UPS Ground & Express, FedEx Ground & Express, or USPS Priority services.
Merchandise Over 120Lbs./box:
IN A CRATE/PALLET:
These will be shipped by professional LTL trucking companies (UPS Freight, FedEx Freight, SAIA Freight, R&L Freight, Roadrunner Freight, etc.). The carrier driver will contact the customer to arrange delivery appointments with the contact information provided.
ASSEMBLED-TESTED PACKAGE:
These will be assigned to a Transporter via various load boards bid. Once the item is dispatched and the load is accepted by the carrier, we will inform the customer via email/account with us. Once the package has been picked up from our location, the driver will contact the customer regarding ETA for delivery.

NOTE: For all merchandise over 120 Lbs./box requires the actual purchaser on site to receive the delivery. For a person other than the purchaser who is receiving the item, we will need written authorization from the purchaser regarding delivery.

ADDITIONAL SHIPPING SURCHARGE
For shipping to addresses that require an additional shipping surcharge, we will contact the customer by phone or email to discuss the surcharge. This applies to pallet shipping or the ready-to-ride shipping package.

ORDER CANCELLATION
Customers can request to cancel an order for merchandise that is shipped in a crate/pallet box in the following ways:
Order Pending Status:
This is the part where the customer is notified about the order that’s been placed to be processed. In this phase, the customer can get a full refund on the order.

NON-CANCELLABLE PHASE:
Order Processing Status: Order Preparation and Order Shipment
This part includes order preparation and order shipment. In this phase, the customer’s order is already processed for shipping along with all the additional paperwork requested for mailing such as MSOs, Odometer Disclosure statements, Bill of Sale, etc.
In this phase, the customer will not be able to cancel the order. If insisted, the customer will be charged the ORIGINAL SHIPPING COST, RETURN SHIPPING COST, and plus a 10% restocking fee. Furthermore, if proof of usage by the customer is found upon inspection, then additional deductions will be placed according to Pioneer Powersports discretion. This fee for ORIGINAL SHIPPING COST, RETURN SHIPPING COST, and a 10% restocking charge will still apply if the customer refuses to receive the package.
Customers can request to cancel an order for merchandise that is shipped Assembled Ready to Ride Package:
Order Pending Status:
This is the part where the customer is notified about the order that’s been placed to be processed. In this phase, customers will be given a refund minus a 9% cancellation fee.

NON-CANCELLABLE PHASE:
Order Processing Status:
This is the phase where the merchandise goes to the assembling line and gets prepared for shipping and then shipped out. In this phase, the customer will not be able to cancel the order. If insisted, the customer will be charged a 25% restocking fee and if the item is already shipped out and the customer refuses to accept the package’s ORIGINAL SHIPPING COST, the RETURN SHIPPING COST will also be deducted on top of the 25% restocking fee.
SHIPPING TRANSIT TIME
For Merchandise Under 120 Lbs./box and Over 120 Lbs./box:
A tracking number will be generated and provided to the customer. This will reflect the approximate transit time for most of the shipping carriers. Transit time will vary by different shipping carriers and different locations, weather, or road conditions. Orders cannot be canceled once the merchandise is in transit. Please refer to the ORDER CANCELLATION policy for more details.
For Merchandise Shipped Assembled with ready-to-ride package:
Once the shipping bid is placed on the Load board and a carrier accepts the load, a dispatch sheet will be provided to the customer upon request. The driver will reach out to the customer to work at a suitable time to have the merchandise delivered. Transit time on this shipping will vary by different shipping carriers and different locations, weather, or road conditions. Orders cannot be canceled once the merchandise is in transit. Please refer to the ORDER CANCELLATION policy for more details about this phase.

SHIPMENT INSPECTION / SHIPPING DAMAGE POLICY
It is very crucial that the customer inspects their shipment(s) upon arrival. Any damages to the shipment(s) including damage to the shipping container should be noted and notified to the carrier and Pioneer Powersports. For shipments in the crate, the customer must note this on the Bill of Lading when signing a receipt for the shipment(s). Customers must report any damages on the shipment(s) to Pioneer Powersports via phone: 817-239-7515 within 48 hours of receiving the shipment(s) for Pioneer Powersports to file a claim for any damages and cover the cost of the damaged parts and shipping with the carrier. If reported after 48 hours Pioneer Powersports will not be responsible for filing a claim for damages and the customer will have to be responsible for covering the cost of the damaged part and shipping.
It is also very crucial that the customer does a box count and writes on the Bill of Lading how many boxes were received before the driver leaves. If the shipment(s) is refused without the approval of Pioneer Powersports, the Order cancellation policy will be in effect and the restocking fee along with any other fees mentioned in ORDER CANCELLATION POLICY will be charged to the customer.
If the customer receives the shipment with structural and frame damages beyond repair, the customer should take pictures of the shipment(s) that clearly shows the damage, refuse the shipment(s), and contact Pioneer Powersports immediately. Pioneer Powersports will start preparing for sending out the replacement unit.
If the customer receives the shipment with minor damages, the customer should take pictures of the shipment(s), accept the delivery, and email Pioneer Powersports. Pioneer Powersports will then send replacement parts to the customer free of charge.
It is also very crucial that the customer does a box count and writes on the Bill of Lading how many boxes were received before the driver leaves. If the shipment(s) is refused without the approval of Pioneer Powersports, the ORDER CANCELLATION policy will be in effect and a restocking fee along with any other fees will be charged to the customer.

RETURN & REFUND POLICY
Customer service is of top priority to Pioneer Powersports thus within 7 days of receiving your vehicle if the customer decides to return or request to exchange the vehicle for any reason, the customer may do so. To do that, please contact our customer service department to process that. This processing will be based on the following Return Policy Agreement:

CONCEALED SHIPPING DAMAGES
In a situation where the customer is not able to note the damages on the BOL or the delivery slip for reasons not limited to failed to inspect, damages were not visible on the packaging, etc. will be considered “Concealed Damagesâ€. Any damages claim reported after 48 hours of delivery receipt will not be valid, thus the customer will have to take responsibility for the cost of parts and shipping.

RETURN POLICY AGREEMENT:
- Please obtain a Merchandise Return Authorization (MRA) number from our Customer Service Department. Any vehicle returned without an MRA number will not be accepted. Also, a copy of your original invoice must be included in the return shipment.
- Customers are responsible for returning the shipment at their own expense.
- Any Freight Collect and COD packages will not be accepted.
- Vehicle must be returned in its original packaging within 7 days in New and re-sellable condition.
- All packaging materials, instruction manuals, and parts must be returned.
- 25%-35% restocking fee may be applied according to the condition of the vehicle. Pioneer Powersports reserves the right to value the vehicle at its own discretion by asking for pictures, and videos from the customer regarding the conditions of the unit.
- For vehicles that have already surpassed 7 days from the date of purchase and have been used, they will not be eligible for return, refund, or exchange.
- Pioneer Powersports strives to maintain very competitive rates for our vehicles and thus our shipping expenses are neither refundable nor reimbursed for any reason, with no exceptions. The shipping cost includes the original first shipment charge and the return shipment charge. If customers are eligible for a return authorized by Pioneer Powersports with a valid MRA, freight/shipping charges will be deducted from the refund.
- Pioneer Powersports will not accept any return on parts, gears, and any other packages under 120 Lbs./box. If for reasons a customer wants to return non-used merchandise shipped under 120 Lbs./box, an MRA number must be requested from the Pioneer Powersports customer service team. Once Pioneer Powersports approves the return with the MRA number, a 6% cancellation fee will be applied. Note: customer will be responsible for return shipping in the original packaging condition for the merchandise. A refund will then be generated for the customer after the deductions. Unauthorized returns will not be accepted and will be subject to various restocking fees based on the condition received. Pioneer Powersports reserves the right to refuse unauthorized returns completely.
- If Pioneer Powersports is unable to fulfill the order and have it shipped within 7-14 Business days. Customers will be eligible for a refund with a 9% cancellation fee.

NOTE: This return policy will not hold for vehicles that went through any type of alterations, abuse negligence, accidents, and lack of proper maintenance. Pioneer Powersports will not accept any return with sustained damages.

REFURBISHED AND USED ITEMS
All refurbished and used items are in their unique condition and are SOLD AS IS, as described in the listing detail. All refurbished and used items are final sale and are not subject to return or refund.

ASSEMBLED READY-TO-RIDE PACKAGE POLICY
Pioneer Powersports offers ready-to-ride packages for customers who request their vehicles to be fully assembled. In this process, Pioneer Powersports will ship out the vehicle in a wood crate or wood pallet depending on the product. In-house, technicians will assemble and road test it before it leaves the warehouse to ensure the quality of the product. Pioneer Powersports provides Assembled ready to ride packages with the same warranty as on all other packages where customers can file a claim to get replacement parts. Please follow the Warranty details for more information on the procedures. On all assembled ready-to-ride packages, if the customer decides to do MRA or return the purchase, the original labor cost of assembling and prep fee will not be refundable.

WARRANTY POLICY
A limited warranty is included with all new vehicles purchased from Pioneer Powersports online. Please carefully read the following for your warranty policy:
The new Vehicle Limited Warranty gives customers specific rights.
NOTE: The New Vehicle Limited Warranty is the only express warranty applicable to your vehicle. Pioneer Powersports is not responsible for any time customer loses, for any inconvenience customers might have to deal with, any loss of transportation, or for any other incidental or consequential damages the customer might experience caused by processing warranty claims through Pioneer Powersports.
Warranty Start Date:
The limited warranty start date is the day the customer takes delivery of their new vehicle. It is very crucial for the customer to report their delivery date to the customer service team and get their vehicle registered with Pioneer Powersports.
Warranty term length:
Please review the warranty term length available at the time of purchase. All customers can select the following term length at will.
- 90 Days- Included with purchase.
- 12 Months- Offered at extra charge.
- 24 Months- Offered at extra charge.
Customer’s Responsibility to Check and Maintain their vehicles:
It is crucial that the customer checks their product once it is received. All assembled ready-to-ride packages are carefully ensured at Pioneer Powersports and go through a quality check before it gets shipped out. All drop-shipped products require professional assembling after the customer receives the product. It is the customer’s responsibility to make sure a professional assembly is performed on the product. Any damages or warranty claims on improper assembling done by the customer will result in voiding the warranty immediately. Once, the customer is on to the phase of using the product, it is recommended that they do a pre-ride inspection and post-ride inspection as follows:
The following are the Pre-Ride and Post-Ride Inspection highlights where the customer is required to perform certain maintenance and or inspection periodically. Please follow the exact procedures on how to do that from the Owner’s Instruction Manual provided with your vehicle:
- Check the oil level.
- Check the air filter.
- Check battery level.
- Check the coolant level.
- Check the brake fluid level.
- Check the chain and sprocket for wear and tear.
- Check Brake pads.
- Check chain slack and lube.
- Tighten all nuts and bolts, use additional seals as needed.
- Check and adjust control levers: Brake and clutch.
- Check air pressure.
- Check the suspension.

PLEASE DO NOT KEEP OPERATING THE UNIT IF THESE HIGHLIGHTED MAINTENANCE LIST IS NOT TAKEN CARE OF. CUSTOMERS SHOULD TAKE THIS LIST AS NOT EXHAUSTIVE BUT SUGGESTIVE IN ADDITION TO ALL OTHER COMPONENTS THAT ARE NOT MENTIONED HERE BUT ARE MENTIONED IN THE OWNER’S MANUAL MAINTENANCE GUIDELINES.
Proper maintenance on the vehicle guards against major repair expenses resulting from neglect or inadequate maintenance and may help increase the value of the vehicle at the time of sale/trade. It is the customer’s responsibility to make sure that all scheduled maintenance is performed and that the materials used meet or exceed the Vehicle’s specifications. Failure to perform scheduled maintenance as specified in the owner’s manual will void warranty coverage on parts affected by the lack of maintenance. Customers should retain receipts for always completed maintenance work and/or materials.

WHAT IS COVERED
Pioneer Powersports warrants every product we sell to be free from the manufacturer’s defects in materials, i.e., the new vehicle doesn’t perform as intended by the Manufacturer when delivered to the purchaser. This limited warranty is for defects from the manufacturer only. The following category of vehicles falls under the Limited warranty provided with the purchase:
THIS APPLIES BOTH ELECTRIC AND GAS VEHICLES:
UTVs, ATVs, Go Karts, Golf Carts, Dirt Bikes, Motorcycles, Motor Scooters, Scooters, Trikes,
Parts covered under warranty:
Drivetrain Components, Exhaust System, Suspension, Wire Harness/ECU, Clutch/CVT/Secondary Clutch, Battery (only 30days-no extended option available).
MORE IN DETAILS FOR THE PARTS THAT ARE COVERED UNDER WARRANTY:
Engine:
All internally lubricated parts, i.e., pistons, piston rings, piston wrist pins, connecting rods, rod bearings, camshaft, camshaft bearings, timing chain, crankshaft, crankshaft main bearings, oil pump, water pump (where applicable), valves, valve springs, valve guides, valve seats, valve lifters, and valve push rods. The engine cylinder head and cylinder will only be covered if damage is caused solely because of the mechanical failure of one or more internal lubricated components listed above.
Engine Case:
The engine case itself will only be covered if the damage caused was solely a result of the mechanical failure of one or more of the internal lubricated components listed above.
Drive System:
All internal lubricated parts contained within the drive axle housing case (where applicable), i.e., differential, differential gears, driveshaft, drive axles, CV joints, axle bearings, reverse gears, and output shafts. The drive axle housing as well as the reverse gearbox housing will be covered, only if damaged solely because of the mechanical failure of one or more of the internal lubricated components contained in the drive axle housing,
Fuel System:
Carbureted vehicles: the carburetor, vacuum fuel pump, intake manifold, fuel tank, and fuel petcock. (Pioneer Powersports does not offer any fuel-injected vehicles at this time; if and/or when we do components covered by the Limited Warranty will include fuel injectors, electronic fuel pump, fuel rail, and fuel pressure regulator.)
Electrical:
Stator, stator pickup, magneto, voltage regulator/ rectifier, CDI, starter relay/starter solenoid and starter motor (where applicable), coil, distributor assembly, and injector relay (if/when applicable).
Cooling System (liquid-cooled vehicles only):
Radiator, radiator cap, thermostat, thermostat housing, temperature indicator sensor or switch, a cooling fan motor(s), water pump, and water pump housing.
Brakes:
Calipers, brake drum housings, drum brake linkage, reservoirs, rotors, and lines. Brake pads and/or linings are not covered.
Chassis:
Frame, swing arms, A-arms, steering controls (linkages, rod ends, steering boxes, and/or racks.)
Transmission (Automatic or Standard):
All internally lubricated parts contained within the transmission case, i.e., flywheel, hydraulic shift linkage, kick start spindle, kick start secondary gear, and transmission gears. The transmission case itself will be covered if any damage was caused solely as a result of mechanical failure of one or more of the internal lubricated components contained within the transmission case.
Pioneer Powersports will supply or, at our option, install in-house, new or rebuilt replacement parts in exchange for defective parts, as well as perform in-house repairs on defective engines at no charge for labor and parts for a period of selected warranty timeframe by the customer at the time of purchase. Customers will be required to ship the defective part back for warranty with the return shipping label. After the expiration of the Limited Warranty, all repair costs are the responsibility of the owner/consumer. Pioneer Powersports provides a ninety (90) day Limited Warranty on all other parts except as noted, from the Start Date by default and for longer term lengths if selected by the customer at the time of purchase.

COVERAGE AND LIMITATIONS
Initial assembly and preparation must be performed in accordance with Assembly Guide provided with the purchase and all work must be performed by professional technicians (i.e., engine repair shop, motorcycle shop, local auto repair shop) or an authorized dealer to assure that the vehicle is in correct working order. Upon completion, you must mail to Pioneer Powersports the **Consumer Motor Vehicle Delivery Preparation and Inspection Form, signed by the technician who performed the service. You will need to provide proof of this service if filing a warranty claim, so retain all receipts. At our sole discretion and subject to the terms stated in this Limited Warranty, Pioneer Powersports agrees to replace a covered component(s) if said component(s) is damaged or fails as a result of mechanical failure of one or more of the internally lubricated parts within the component’s stated warranty period from the Limited Warranty Start Date if the component is being used under the conditions and in the manner intended and/or specified by the original manufacturer.
Remember, these units are built for recreational or transportation use only. Warranty claims may be denied for abuse or misuse of the vehicle. Pioneer Powersports is not responsible for any damages arising from abuse; accidents, collision, or objects striking the vehicle; driving or riding through water deep enough to cause water to be ingested into the engine; fire or explosion; freezing; misuse, natural disasters; theft, vandalism, or riot; use of contaminate or improper fluids or fuel; or any modifications not performed by Pioneer Powersports.
Abuse or misuse may include:
- Jumping
- Stunt riding.
- Racing
- Riding at constant wide-open throttle
- Use of vehicle as a rental unit
- Damage caused by an accident.
- Use of vehicle in a manner for which it was not designed or engineered.
- Abuse and or damage caused by an inexperienced rider.
- Improper adjustment or operation of the clutch; examples include dragging or slipping the clutch, causing premature burning of the friction plates.
- Improper adjustment and/or operation of the brakes
- Improper gear engagement, for example, engaging reverse while traveling forward.
- Improper maintenance or not following Scheduled Maintenance Guide
- Repairs not performed by a professional technician or a Mechanic Licensed Dealer
- Use of incorrect lubricants
- Improper initial setup
- Use of aftermarket parts for repairs

The Limited Warranty does not cover damage caused by failure to maintain the vehicle, improperly maintaining the vehicle, or using the wrong part(s), fuel, oil, lubricant(s), or fluid(s). See your Owner’s Manual for correct fluid types and levels and read the Scheduled Maintenance Guide for maintenance and service requirements.
The Limited Warranty does not cover: (1) parts and labor needed to maintain the vehicle; and (2) the replacement of parts due to normal wear and tear. You, the owner, are responsible for these items. Examples of this include oil changes, oils; lubricants and other fluids, oil and air filters; brake lining and/or pads; tire rotations (where applicable); cleaning and polishing; clutch linings; engine tune-ups.
Parts Not Covered by the Limited Warranty:
Air Filters, Axles, Ball Joints, Batteries, Belts, Body Plastic, Bolts, Brake Pads, Brake Shoes, Cables, Chains, Clutch Wear Parts, Drive Belts, Drive Shifts, External Springs, Fasteners of All Types, Foot Pedals, Footpegs, Fuel Filter, Gaskets, Grips, Hand Levers, Handlebars. Hoses, Light Bulbs, Lights, Mirrors, Oil Filter, Seals, Seats, Shift Levers, Shock Absorbers, Spark Plugs, Sprockets, Tires, Tubes, Wheel Rims, Wheel Spokes, and Spoke Nipples.
If You Need Warranty Repairs:
All warranty repairs must be processed and performed by Pioneer Powersports. Always contact us first! For warranty issues or repairs, must provide a copy of the original invoice showing our model number, vehicle identification number (VIN), and date of purchase, as well as a copy of your Consumer Motor Vehicle Delivery Preparation and Inspection Form, before we can warrant your product directly. In either case, after obtaining an RMA number from Pioneer Powersports, you will be instructed to ship back the original parts. Pioneer Powersports reserves the right to decline any warranty claim based on the criteria listed in the Coverage and Limitations portion of this Limited Warranty.
Towing Charges:
All towing charges incurred are the responsibility of the customer.
Labor Charges:
Pioneer Powersports does not pay for labor to repair or replace component(s) or part(s) subject to wear and tear (see: Parts Not Covered by Limited Warranty), or component(s) or part(s) sustaining damage from abuse, accident(s), and/or shipping under the terms of the Limited Warranty. The Limited Warranty does not cover any damage caused by or resulting from shipping, misuse, abuse, or other reason except for a manufacturer’s defect.
All warranted parts must first be sent to Pioneer Powersports for inspection and verification of defect(s) for inspection and testing for defects. Until the parts are sent to us, replacement parts will not be sent under the terms of the Limited Warranty. Failure to do so may result in you getting the wrong part. We are not responsible for wrong parts sent if we do not have your part to exchange and verify the correct part numbers.
In some cases, the parts may have to be shipped from overseas and may take up to 8 weeks for delivery. Contact our Parts Dept. at
Customers are responsible for shipping charges incurred from shipping warranty components to Pioneer Powersports and repaired or replacement parts to the original owner under the terms of the Limited Warranty.
Important Notes:
Pioneer Powersports reserves the right to determine if the damage is due to a manufacturer’s defect (defective materials or factory workmanship) and what is due to abuse or misuse of the vehicle. Pioneer Powersports is not responsible for any time you lose, any inconvenience you might be caused, the loss of your transportation, loss of use, loss or damage arising from injury, rental vehicle(s), loss of profits, or loss of income, or for any other incidental or consequential damages you may have as the result of a failure of any component(s) or part(s).
This Agreement and Limited Warranty Is Null and Void If:
- Pioneer Powersports does not provide a reasonable opportunity to inspect a covered component or part prior to removal, repair, or replacement of any component(s) or part(s) covered under this Limited Warranty.
- Damage to the component(s) or part(s) is caused by a non-covered component(s) or part(s), or by any component(s) or part(s) not purchased from Pioneer Powersports.
- The vehicle owner fails to follow the minimum maintenance and break-in requirements specified by Pioneer Powersports in the Owner’s Manual and/or fails to provide proper service documents or records.
- The vehicle is entered or used in any form of competitive riding.
No Implied Warranties or Agreements:
There are no agreements or warranties, expressed or implied, including warranties of merchantability or fitness for a particular purpose, other than those stated in this Limited Warranty. This Limited Warranty extends only to the original customer and is non-transferable.
There Is NO Warranty On Pioneer Powersports Vehicles That Are Intended to Be Used for Racing Purposes Only

WAIVER OF LIABILITY
The following Waiver of Liability is a legal and binding contract, executed in the State of California.

I, as a buyer, acknowledge and agree to be above 18 years of age or are the parent of a child under the age of 18 years. I, as a buyer, acknowledge and understand that riding an all-terrain-vehicle (ATV), dirt bike, go-kart, motorcycle, moped, pocket bike or gas scooter is a dangerous activity that requires strenuous exercise and various degrees of skill and experience for individual riders.
I, as a buyer, understand that these activities can result in serious injury to the person and damage to property and voluntarily assume any and all risks associated with loss, damage, or injury while riding the vehicles advertised on our website.
I, as a buyer, am aware of the risks, hazards, and dangers of personal injury, death, and disability inherent with the specific use of these vehicles as well as the inherent risks, hazards, and dangers of personal injury and disability increase with inexperienced riders.
I, as buyer, agree to release and forever discharge Pioneerpowersports.com or its parent company and their agents, servants, employees, officers, directors, trustees, and all other persons or entities acting on their behalf and the manufacturer from any and all claims, actions, damages, liabilities, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to your participation or use of these vehicles, use of equipment or property supplied by Pioneerpowersports.com or its parent company or your presence upon the premises, whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, manufacture or distributor.
By this Agreement, it is my intention as buyer, to surrender and waive any rights to sue or exercise any legal rights to seek damages from Pioneerpowersports.com or its parent company and their agents, servants, employees, officers, directors, trustees, and all other persons or entities acting on their behalf. This Agreement shall be affecting and binding upon my heirs, agents, personal representatives and assigns.
I, as the buyer, hereby certify that I am over the age of 18 years of age.
I, as a buyer, have carefully read the foregoing and acknowledge that I understand and agree to all the above Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the effect of the same. I, as a buyer, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release certain substantial rights that I may have or possess. I, as a buyer, therefore release all liability and waive all rights I may have in regard to my child’s activities with any items purchased from Pioneerpowersports.com.

PURCHASERS RESPONSIBILITY
Customers must inspect all equipment before using it and take full responsibility for assuring that the equipment is in good working order and safe to use. You further understand that you are responsible for damage to equipment. Purchaser understands the nature of motor scooter riding and motorcycle-related activities and acknowledges that Purchaser is qualified to operate said motor scooter, and is in proper physical condition to participate in such activity. Purchaser agrees to assume all risks when allowing others to operate Purchaser’s products.

INHERENT RISKS
Warning! Riding activities of dirt bikes, scooters, ATVs, go-karts, pocket bikes, and UTVs involve the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment, and death. These inherent risks and dangers may be caused by the Purchaser’s own actions or inactions, the actions, or inactions of others, participating or not participating in the activity, the condition in which the activity takes place, or the negligence of others. There may be additional risks, including social and economic loss, either known or unknown to Purchaser, not readily foreseeable, and Purchaser fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred as a result of Purchaser’s participation in motorcycle riding activity.

OPERATION, REGISTRATION, AND LICENSE
The purchaser is responsible for registering and operating the motorcycles in accordance with local and state laws and ordinances. The seller makes no representations that motor scooters, dirt bikes, and ATVs are legal for operation in your City and State. Customers have read and understood the use of these products before purchasing.
